Terms & Conditions
Last Updated: 18 April 2025 · Effective Date: 18 April 2025
These Terms and Conditions ("Agreement") govern the relationship between Kindredpage ("the Studio", "we", "us", "our") — a studio registered in Malaysia and located at Suite 22-3, Jalan Bukit Bintang, 55100 Kuala Lumpur — and any individual ("you", "the Participant", "User") who uses the studio website at kindredpageed.pro or books or attends a session at the studio.
By submitting an enquiry form, confirming a booking, or attending a session, you agree to be bound by this Agreement in its current form.
1. Definitions
- "Studio" means Kindredpage, its facilitators, and any staff acting on its behalf.
- "Session" means any Kindred Album Workshop, Personal Catalog Block, or Yearlong Membership session offered by the Studio.
- "Participant" / "User" means any individual who books, attends, or interacts with the Studio through the Site or in person.
- "Site" means the studio website at kindredpageed.pro.
- "Materials" means archival paper, adhesives, album sleeves, and other physical supplies provided by the Studio during sessions.
- "Output" means any album pages, catalog book, or printed addition produced during or as a result of a session.
2. Acceptance of Terms
By booking a session or using the Site, you confirm that:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding agreement.
- You have read and understood these Terms and Conditions.
3. Service Description
Kindredpage offers three facilitated session formats:
- Kindred Album Workshop — a three-hour group workshop for starting a family photograph album using archival materials.
- Personal Catalog Block — a four-session individual block for building a printed archival catalog of household objects of significance.
- Yearlong Album and Catalog Membership — a twelve-month individual membership including quarterly sessions, open workshop access, and an annual printed addition.
All sessions are conducted in person at the studio address in Kuala Lumpur. The Studio does not currently offer remote or online sessions. Session availability is subject to studio capacity and may change without notice.
Important scope limitation: All Studio sessions are educational and archival in nature. The Studio does not provide — and sessions do not constitute — legal advice, financial advice, insurance advice, property appraisal, or any other regulated professional service. No item is appraised, valued, or filed with any external party.
4. Booking and Confirmation
- A booking is confirmed only upon receipt of full payment (or an agreed first installment for the Personal Catalog Block).
- The Studio reserves the right to decline a booking at its discretion.
- Booking confirmation will be sent by email to the address provided at the time of enquiry.
5. Payment Terms
- All fees are quoted and payable in Malaysian Ringgit (RM).
- Current session fees: Album Workshop RM 490 per person; Personal Catalog Block RM 1,340 per participant; Yearlong Membership RM 2,860 per year.
- The Studio accepts bank transfer and major Malaysian e-wallet services. No credit card processing is performed by the Studio directly.
- For the Personal Catalog Block, payment may be split into two installments by prior arrangement at booking — the first installment is due at booking confirmation and the second no later than the second session date.
6. Cancellation and Rescheduling
- Cancellations made 10 or more business days before the session date: full refund of the session fee, less any materials cost already incurred.
- Cancellations made 5–9 business days before the session date: 50% refund of the session fee.
- Cancellations made fewer than 5 business days before the session date: no refund.
- Rescheduling requests made 5 or more business days before the session date will be accommodated where availability allows, at no additional charge.
- Rescheduling requests made fewer than 5 business days before the session date will be handled on a case-by-case basis. A rescheduling fee of RM 80 may apply.
- If the Studio cancels a session for any reason, a full refund will be issued or an alternative date offered at the Participant's choice.
- Yearlong Membership cancellations after the membership has commenced are non-refundable for the remaining period, except where the Studio is unable to provide the sessions agreed.
7. Participant Responsibilities
- Participants are responsible for bringing their own photographs to workshop and membership sessions. Guidance on print formats is provided at booking confirmation.
- Participants are responsible for the safekeeping of any personal items brought to the studio. The Studio is not liable for loss or damage to items brought on-site beyond reasonable care during the session.
- Participants must not share, reproduce, or distribute studio facilitation materials, including session guides and methodology notes, without written permission from the Studio.
- Participants must behave with consideration for other participants in group sessions.
8. Intellectual Property
- All photographs, objects, and written material brought to sessions by a Participant remain the property of the Participant.
- The Output produced during a session (album pages, catalog book, printed addition) belongs to the Participant upon delivery.
- The Studio's facilitation methodology, session frameworks, and website content are the intellectual property of Kindredpage. No license to use or reproduce these is granted by attendance at a session.
9. Disclaimers
- Sessions are provided for educational and archival purposes only. The Studio makes no representations about the suitability of any session outcome for legal, financial, insurance, or official documentation purposes.
- The Studio does not represent that printed outputs will be accepted by any authority, institution, or third party for any purpose.
- The durability of printed outputs depends on storage conditions after delivery. The Studio's materials are rated for standard indoor conditions; the Studio is not liable for deterioration resulting from improper storage by the Participant.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law:
- The Studio's total liability to any Participant for any claim arising from or related to a session shall not exceed the fee paid for that session.
- The Studio is not liable for indirect, consequential, or incidental damages of any kind.
- The Studio is not liable for events beyond its reasonable control, including utility failures, building access issues, or other force majeure events that prevent a session from proceeding.
11. Indemnification
You agree to indemnify and hold harmless Kindredpage, its facilitators, and staff from any claims, losses, or expenses arising from your breach of this Agreement or your misuse of session Materials or Outputs.
12. Termination
- The Studio may terminate a booking or membership if a Participant breaches these Terms, behaves in a manner that disrupts other participants, or provides false information at booking.
- In such cases, the cancellation refund policy in Section 6 applies.
- A Participant may terminate a booking at any time subject to the cancellation terms in Section 6.
- Sections 8, 9, 10, 11, and 13 survive termination of this Agreement.
13. Dispute Resolution and Governing Law
- This Agreement is governed by the laws of Malaysia.
- Any dispute arising from this Agreement shall first be subject to informal resolution — Participants are encouraged to contact the Studio directly at [email protected] before initiating formal proceedings.
- If informal resolution is unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
- Consumer rights under the Malaysian Consumer Protection Act 1999 are not affected by these terms.
14. General Provisions
- Entire Agreement: This Agreement, together with any booking confirmation and the Privacy Policy, constitutes the entire agreement between the Studio and the Participant in respect of the relevant session.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure by the Studio to enforce any provision does not constitute a waiver of its right to do so in the future.
- Assignment: You may not assign your booking or membership to another person without the Studio's written consent.
15. Changes to These Terms
The Studio may update these Terms from time to time. Material changes will be noted by the updated date at the top of this page. Bookings confirmed before the effective date of any change are governed by the Terms in force at the time of confirmation.
